EveryMom Fitness Waiver

In exchange for permission to participate, both individually and with my child/children, in exercise classes and use of related products and exercise equipment designed or provided by EveryMom Fitness or Home Field Advantage, I hereby enter into the following release and waiver of liability, assumption of risk and indemnity agreement. I, for myself, my child/children, my and their heirs, my spouse, my and their executors, administrators, personal representatives and assignees, hereby waive, release, discharge, indemnify, hold harmless and agree not to sue EveryMom Fitness, or Home Field Advantage, its officers, directors, shareholders, employees, landlords, sponsors, representatives, volunteers, affiliates and EveryMom Fitness’ said instructors (hereafter the "Released Parties") from any and all liability, responsibility, damages, losses, claims, demands, actions, suits, judgments, costs and expenses (including attorneys' fees) resulting from personal injury, accidents, illnesses, deaths and/or property loss caused in any manner, including the simple active or passive negligence of the Released Parties, by my and my child's/children's participation in and use of EveryMom Fitness Products and Programs.
I acknowledge that the EveryMom Fitness Programs are designed to stress the heart, lungs, cardiovascular and circulatory systems, muscles, joints, ligaments and tendons in an attempt to improve muscular strength and cardiovascular fitness. I acknowledge I have been advised to consult with my physician with respect to my and my child's/children's ability to participate in and to endure the EveryMom Fitness Program. I knowingly assume all risks relating to my/our participation in and use of EveryMom Fitness/Home Field Advantage Equipment and Programs.
I acknowledge that I have discussed with my physician the appropriateness and safety of EveryMom Fitness/Home Field Advantage Products and Programs in connection with any illness or condition that I or my child/children now have or previously had and that I knowingly execute this Agreement freely and voluntarily and intend by my signature to grant a complete and unconditional release of all liability to the greatest extent allowed by law.
I have read this agreement, fully understanding the terms. I understand that I am giving up substantial rights, including my right to sue and the right of my child(ren) to sue. This agreement is intended to be as broad and inclusive as permitted by law. If any portion of this agreement is held invalid, the remaining portions will continue in full force and effect.
